**In one line:** From 27 October 2026, every train ticket sold at a counter must carry the insurance that online buyers could choose, on the Supreme Court's order.

A Supreme Court bench of Justices Ahsanuddin Amanullah and R. Mahadevan has directed that "all tickets sold over the counter at all railway stations shall also be covered by insurance in the same manner as tickets purchased online", from 27 October 2026. The order, made at the hearing on 6 October, says the direction "shall be implemented mandatorily, failing which the responsibility shall be directly upon the Railway Board". Until now, travel insurance was optional and available only to Indian citizens booking e-tickets on IRCTC, at a premium of 45 paise per passenger including taxes. Passengers buying at reservation counters had no such option. The next hearing is on 16 November 2026.

The order came in Union of India v. Radha Yadav, which began as an appeal over compensation for a passenger killed in a train accident; while deciding that appeal in 2019, the Court took up wider railway safety issues. It has since examined Kavach, the indigenous automatic train protection system, track fencing, foot over bridges and insurance for offline tickets. Amicus curiae Shikhil Suri raised the insurance issue. The bench recorded its "utter disappointment and displeasure" and said budgetary provisions for the safety of the common man "have not been fully utilized". Additional Solicitor General Vikramjit Banerjee, for the Centre, sought one last chance to file an affidavit explaining progress and why fencing targets were missed.

The order adds a layer to existing protections. Section 124A of the Railways Act, 1989 already makes the railway pay compensation for death or injury in an untoward incident whether or not it was at fault, with ₹8 lakh for death; claims go to the Railway Claims Tribunal. Online travel insurance adds cover of up to ₹10 lakh for death. On prevention, a PIB backgrounder says consequential train accidents fell from 135 in 2014-15 to 31 in 2024-25, and Kavach had been implemented on more than 2,200 route km by January 2026. Supporters see the order as equal treatment for counter passengers. It also renews the debate over how far courts should direct railway administration and budgets, a domain of the executive.

## Prelims practice question

With reference to railway passenger protection in India, consider the following statements:
1. Under Section 124A of the Railways Act, 1989, compensation for an untoward incident is payable whether or not the railway was at fault.
2. Claims for such compensation are filed before the Railway Claims Tribunal.
3. Until the Supreme Court's 2026 order, IRCTC travel insurance was compulsory for all passengers.
Which of the statements given above is/are correct?

(a) 1 only
(b) 1 and 2 only
(c) 2 and 3 only
(d) 1, 2 and 3

Answer: (b) 1 and 2 only. Statement 1 is correct: Section 124A applies whether or not there was any wrongful act, neglect or default. Statement 2 is correct: claims go to the Railway Claims Tribunal under Section 125. Statement 3 is wrong: insurance was optional and only for e-tickets.

## Mains practice question

The Supreme Court's direction to insure all counter-sold railway tickets shows courts supervising the executive on public safety. Discuss the merits and limits of such continuing judicial supervision. (150 words)

### Model answer

On 6 October 2026 the Supreme Court ordered that all counter-sold train tickets carry insurance from 27 October, making the Railway Board directly responsible, in a railway safety matter the Court has monitored since 2019.

## Merits
- **Equal protection**: counter passengers get the cover that online buyers could buy for 45 paise.
- **Accountability**: the Court noted unspent safety budgets and missed fencing targets, and fixed compliance dates.
- **Continuing mandamus**: keeping the case open lets the Court track Kavach, fencing and foot over bridges over time.
- **Article 21**: courts read the right to life broadly, and passenger safety fits that reading.

## Limits
- **Separation of powers**: budgets and safety priorities are executive choices.
- **Expertise**: courts cannot assess technical rollout of Kavach.
- **Implementation**: a short deadline strains insurers and ticketing systems.

Judicial supervision works best when it sets deadlines and asks for reasons, leaving technical choices to the Railways.

## The basics

## Why this matters

Who protects a railway passenger, and how? Three layers exist: a no-fault compensation duty under the Railways Act, safety technology such as Kavach, and optional travel insurance for online tickets. The Supreme Court's order closes a gap in the third layer. It is also a good example of a court supervising the executive over a long period, which is a core GS2 debate.

## Layer one: compensation in law

Section 124A of the Railways Act, 1989 makes the railway pay compensation for death or injury in an untoward incident, whether or not the railway was at fault. The amount for death is ₹8 lakh, raised from ₹4 lakh. Claims go to the Railway Claims Tribunal under Section 125.

## Layer two: insurance

Optional insurance with an IRCTC e-ticket covers ₹10 lakh for accidental death or permanent total disability, up to ₹7.5 lakh for permanent partial disability, up to ₹2 lakh for hospitalisation and ₹10,000 for transport of mortal remains (figures as reported in 2025). Passengers buying at a counter could not get it. The Court has now ordered that counter tickets be covered "in the same manner as tickets purchased online".

## Layer three: preventing accidents

Kavach is India's indigenous automatic train protection system. It applies brakes on its own if a train passes a danger signal or overspeeds and helps prevent collisions. Its rollout is one of the issues the Court has examined in this case.

## The court as supervisor

The bench has kept the case open, widened it from Kavach to fencing, foot over bridges and insurance, and fixed dates for compliance. This method of Continuing mandamus lets a court monitor the executive over time instead of deciding once and closing the file.
