EC tells Supreme Court the CEC can be removed only like a Supreme Court judge

The Election Commission of India (ECI) has filed a joint counter-affidavit of nearly 250 pages in the Supreme Court, approved by Chief Election Commissioner (CEC) Gyanesh Kumar and Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi. Filed late on 26 October 2026, it answers petitions, including pleas by the Leader of the Opposition in the Lok Sabha and other INDIA bloc leaders, that question the CEC's functioning and seek to restrain him from working. The ECI says the pleas are not maintainable because they rest on a newspaper report, and "newspaper reports cannot be considered as evidence in the eyes of law". It adds that the petitions do not dispute that the CEC was lawfully appointed, so a prayer for quo warranto (a writ asking by what authority a person holds a public office) is misconceived.

Prelims facts
  • Article 324(5) says the CEC can be removed only in like manner and on the like grounds as a Supreme Court judge, and his conditions of service cannot be varied to his disadvantage after appointment.
  • Other Election Commissioners can be removed only on the recommendation of the CEC, under the second proviso to Article 324(5) and Section 11(3) of the 2023 Act.
  • Section 18 of the 2023 Act requires the Commission to transact business unanimously as far as possible, and by majority when members differ.
  • The ECI's affidavit says SIR orders of 24 June 2025, 27 October 2025 and 14 May 2026 were unanimous and that Form 6 was never amended.
  • In T.N. Seshan v. Union of India (1995), the Supreme Court upheld the multi-member Commission and held that the CEC's removal protection does not make him superior to the other Commissioners.

Centre amends motor vehicle rules to allow E85 and E100 ethanol fuel in flex-fuel vehicles

The Ministry of Road Transport and Highways (MoRTH) has amended the Central Motor Vehicles Rules, 1989 to recognise E85 (85% ethanol, 15% petrol) and E100 (nearly pure ethanol) as fuels for flex-fuel vehicles. The gazette notification is dated 23 October 2026, and the ministry announced it on 26 October. The changes update emission tables, fuel specifications and testing provisions so that vehicles built for high ethanol blends can be certified (homologated) and sold. A flex-fuel vehicle is one whose engine and fuel system are designed to run on petrol, ethanol or any blend of the two.

Prelims facts
  • MoRTH's amendment to the Central Motor Vehicles Rules, 1989, notified on 23 October 2026, recognises E85 and E100 as fuels for flex-fuel vehicles.
  • E85 and E100 may be used only in vehicles designed and certified for them by manufacturers; E20 and petrol vehicles cannot use them.
  • The weight limit for the light petrol and diesel vehicles covered by the testing provisions rises from 3,000 kg to 3,500 kg.
  • The National Policy on Biofuels, 2018 (amended 2022) advanced the E20 target from 2030 to 2025-26; India reached 20% blending in 2025.
  • Maruti Suzuki's Wagon R Flex Fuel (June 2026) is described as India's first flex-fuel passenger vehicle.

Defence Acquisition Council clears ₹2.12 lakh crore of proposals, 82% from Indian industry

The Defence Acquisition Council (DAC), chaired by Defence Minister Rajnath Singh, on 26 October 2026 granted Acceptance of Necessity (AoN) to capital acquisition proposals worth about ₹2,12,000 crore for the Army, Navy and Air Force. The Defence Ministry said about 82% of the procurement will be made from Indian industry. AoN is the DAC's in-principle approval of a requirement: it is the first formal step in buying a weapon system, after which the services issue tenders, run trials and negotiate contracts. It is not a contract and does not by itself spend money.

Prelims facts
  • On 26 October 2026 the DAC granted AoN to proposals worth about ₹2.12 lakh crore; about 82% will be procured from Indian industry.
  • AoN is in-principle approval of a requirement and the first step in capital acquisition; tenders, trials, negotiations and contracts follow.
  • The DAC, chaired by the Defence Minister, was set up in 2001 after the Group of Ministers' review of national security that followed the Kargil War.
  • Army items include a platform-based Counter-UAS to protect tanks, VSHORADS, Light Multi Role Helicopters and a long-range kamikaze drone system.
  • The Navy's Active Offboard Decoy System is meant to strengthen anti-missile defence; the Air Force gets a Mobile X-Band Doppler Weather Radar System for forward areas.

Editorial: Is the NMC's withdrawal of college standards rules a 'dubious retreat'?

The National Medical Commission (NMC), India's regulator of medical education and practice, has de-notified the Maintenance of Standards of Medical Education Regulations, 2023 (MSMER-2023). The notification is dated 14 October 2026 and was published in the Gazette on 16 October. MSMER-2023, notified in September 2023, set out penalties for medical colleges that failed to meet standards or gave false information: fines of up to ₹1 crore per violation for institutions, fines on faculty, deans and doctors for false declarations or records, cuts in student intake, stopping admissions, and withholding or withdrawing accreditation for up to five academic years. It also asked colleges to file an Annual Disclosure Report (ADR) on faculty, infrastructure and clinical material.

Prelims facts
  • The NMC de-notified MSMER-2023 by a notification dated 14 October 2026, published in the Gazette on 16 October 2026.
  • MSMER-2023 allowed fines of up to ₹1 crore per violation on medical colleges, cuts in intake and withdrawal of accreditation for up to five academic years.
  • The Annual Disclosure Report remains mandatory under Sections 24(i) and 25(h) of the NMC Act, 2019, and MARB keeps its inspection powers.
  • The NMC Act, 2019 replaced the Medical Council of India; the NMC was constituted on 25 September 2020 with four autonomous boards.
  • The Hindu's editorial argues the withdrawal weakens action against 'ghost faculty' and individual wrongdoers, and flags MARB's poor record on publishing assessments.

Op-ed: Kudankulam leak shows nuclear cyber risk now lies with contractors

An article on The Hindu's Lead page on 27 October argues that protecting critical infrastructure such as nuclear plants can no longer stop at the plant's fence. It starts from the Kudankulam Nuclear Power Project (KKNPP) leak reported in July 2026. The ransomware group World Leaks posted close to 19,000 files, totalling 14.3 GB, on the dark web, labelled as coming from the Reliance Group and online since 11 June. Reported contents included ventilation and cooling blueprints for Units 3 and 4, the layout of a common control room, vendor proposals, an approved supplier list and records of a 2024 joint inspection. Reliance Infrastructure, which won the contract for the project's common service facilities through a 2018 tender, confirmed a "partial breach" of data on a server hosted by Yotta, a third-party data centre.

Prelims facts
  • In July 2026 World Leaks posted close to 19,000 Kudankulam-related files (14.3 GB) taken from a Reliance server hosted by third-party data centre Yotta.
  • NPCIL said the files concerned conventional balance-of-plant facilities and were unconnected to nuclear safety or security systems.
  • NCIIPC, created under Section 70A of the IT Act, 2000 and notified on 16 January 2014, is a unit of NTRO and the nodal agency for critical information infrastructure.
  • CERT-In's directions of 28 April 2022, issued under Section 70B(6), require cyber incidents to be reported within six hours and logs kept for 180 days in India.
  • The op-ed argues that vendor contracts, third-party audits and data minimisation must extend security beyond the plant's perimeter.

Op-ed makes the case for double-fortified salt to tackle anaemia

The Hindu, Page 6OpinionGS2Prelims

An op-ed argues that anaemia persists despite long-running programmes and that India already has a ready delivery channel in salt. Double-fortified salt (DFS), carrying both iron and iodine, can build on the near-universal use of iodised salt. It says DFS and fortified rice must sit alongside supplementation, screening, treatment and deworming under Anaemia Mukt Bharat, since fortification cannot address non-nutritional causes.

Prelims facts
  • NFHS-5 found 67.1% of children and 59.1% of adolescent girls anaemic.
  • Double-fortified salt is fortified with both iron and iodine; about 95% of Indian households already use iodised salt.
  • Fortified rice under government programmes carries iron, folic acid and vitamin B12.
Mains angle

Gives a costed, low-cost intervention for GS2 questions on malnutrition and public health; the op-ed cites a cost of about ₹14 to 20 per person a year and a benefit-cost ratio of 4.2:1 for DFS.

Asked before

2024 · GS2 · 10 marks Poverty and malnutrition create a vicious cycle, adversely affecting human capital formation. What steps can be taken to break the cycle?

How to use it: Food fortification through double-fortified salt and fortified rice, combined with Anaemia Mukt Bharat's supplementation and deworming, is a concrete step to break the malnutrition cycle.

What powers do Special Executive Magistrates have

The Hindu, Page 8ExplainedGS2Prelims

The detention of activists through preventive proceedings has renewed debate over Special Executive Magistrates (SEMs). Under Section 15 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the State Government can appoint SEMs, including police officers not below the rank of Superintendent of Police. SEMs can require a person likely to breach the peace to execute a bond, but they are executive officers: they cannot hold criminal trials or convict anyone, and their orders are subject to judicial review.

Prelims facts
  • Section 126 of the BNSS allows an Executive Magistrate to require a bond for keeping the peace for a period not exceeding one year.
  • Judicial Magistrates of the first and second class are provided for under Section 9 of the BNSS.
Mains angle

Useful for GS2 on separation of powers and personal liberty: police officers acting as magistrates in preventive detention can raise Article 21 and Article 19(1)(b) concerns, and SEM orders remain subject to judicial review.

New York City's 'click to cancel' rule and India's rules against subscription traps

The Hindu, Page 9ExplainedGS2Prelims

New York City's Department of Consumer and Worker Protection has a "first-in-the-nation municipal rule" that took effect on 1 October 2026. It requires businesses to explain subscription terms clearly and offer cancellation by the same method as sign-up, with civil penalties starting at $525. In India, the Central Consumer Protection Authority's 2023 dark-pattern guidelines list the "subscription trap", which makes cancelling a paid subscription impossible or unnecessarily difficult.

Prelims facts
  • The Central Consumer Protection Authority notified the Guidelines for Prevention and Regulation of Dark Patterns on 30 November 2023 under Section 18 of the Consumer Protection Act, 2019.
  • The 2023 guidelines list 13 specified dark patterns, including the subscription trap.
  • New York City's click-to-cancel rule is enforced by its Department of Consumer and Worker Protection.
Mains angle

Gives a comparative example for GS2 consumer protection in the digital economy: rules on easy cancellation tackle dark patterns that exploit consumer inertia.

News publishers challenge the Digital Personal Data Protection Act in the Supreme Court

Indian Express, Page 1GS2GS3Prelims

The Digital News Publishers Association, representing the digital wings of 21 news organisations, and a journalist have challenged the Digital Personal Data Protection Act, 2023 and its 2025 Rules under Article 32. They argue that the Act has no exemption for journalism, so consent, notice and erasure duties would hinder reporting, and that the government's information-seeking powers could expose sources. A bench led by CJI Surya Kant issued notice, returnable on 17 November.

Prelims facts
  • Section 44(3) of the DPDP Act, 2023 amends Section 8(1)(j) of the RTI Act, and is among the provisions challenged.
  • The petitioners say Section 17(2) exempts research and archiving but not public-interest journalism.
  • The petition argues the Data Protection Board is selected by the executive and has no required judicial member.
Mains angle

Useful for GS2 on balancing privacy (Article 21) with press freedom and the right to information: the petition cites the Electoral Bonds judgment to argue that the right to know cannot be subordinated to privacy.

Asked before

2024 · GS3 · 10 marks Describe the context and salient features of the Digital Personal Data Protection Act, 2023.

How to use it: Shows contested features of the DPDP Act: no journalism exemption, Section 44(3)'s amendment of RTI Section 8(1)(j), and an executive-selected Data Protection Board.

China says it is strictly abiding by its border agreements with India

Indian Express, Page 8GS2

Chinese Foreign Ministry spokesperson Guo Jiakun said on 26 October that China "strictly abides by the relevant agreements and common understandings" with India and conducts normal patrols. He was responding after MEA spokesperson Randhir Jaiswal said the situation along the Line of Actual Control is disturbed from time to time when Chinese forces diverge from established patrolling patterns. That followed ITBP chief Shatrujeet Kapur's remark that confrontations continue at several sites in Arunachal Pradesh.

Prelims facts
  • Prime Minister Narendra Modi met President Xi Jinping on the sidelines of the BRICS summit in New Delhi in September 2026.
  • India says both sides use existing diplomatic and military mechanisms to avoid misunderstanding and miscalculation along the LAC.
Mains angle

Useful for GS2 India-China relations: the normalisation since the 2020 Galwan clash rests on patrolling understandings, and face-offs in Arunachal Pradesh show how fragile they remain.

Opinion: India needs storage and transmission to fix daytime power surplus and night deficits

Indian Express, Page 10OpinionGS3Prelims

An Indian Express article argues that India's power sector has moved from chronic shortage to surplus during solar hours and shortfalls at night. Solar output peaks by day, while coal outages, air-conditioning demand and low reservoirs squeeze evening supply. It calls for battery and pumped storage, a stronger transmission network, shifting flexible demand to daytime, and markets that reward flexibility.

Prelims facts
  • Renewable capacity including large hydropower is about 292 GW, roughly 53% of India's installed capacity.
  • India's installed solar capacity is about 162 GW.
  • Pumped storage hydropower and battery storage can shift daytime solar surplus to night-time peak demand.
Mains angle

Useful for GS3 energy transition: the article argues India must move from adding capacity to ensuring reliable, flexible power when it is needed.

Asked before

2022 · GS3 · 15 marks Do you think India will meet 50 percent of its energy needs from renewable energy by 2030? Justify your answer. How will the shift of subsidies from fossil fuels to renewables help achieve the above objective? Explain.

How to use it: Renewables are already about 53% of installed capacity, but meeting demand from them needs storage, transmission and flexible markets to cover night-time deficits.

Can private school teachers be made to do Census duty

Indian Express, Page 13ExplainedGS2Prelims

The Centre has amended the Census Rules, 1990 so that teachers of aided or unaided private bodies can be appointed as enumerators for Census 2027. Private unaided schools have challenged such requisitions, arguing that Section 4A of the Census Act, 1948 covers only officers and staff of local authorities. The Punjab and Haryana High Court stayed two Haryana government communications seeking details of teachers for census duty.

Prelims facts
  • Section 4A of the Census Act, 1948 deals with making officers and staff of local authorities available for census work.
  • Census 2027 population enumeration in Goa, Uttar Pradesh, Punjab and non-snow-bound Uttarakhand runs from 1 December 2026 to 4 January 2027.
Mains angle
